Hello,
If one gets stuck with H1b revalidation, and then gets approved after 6 months. Is there any issues when coming back to the US at the POE entry?

No issues, but make sure you have a updated employment verification letter from your employer saying that you still have a job. I have seen some cases with my friends where the immigration officer asked for a letter when they were outside the country for more than 3 months....One of my friends did not have a letter and the officer called his employer and verified that he still has a job before letting him in....So I would just carry a letter to be on the safe side rather than going through the hassle.....

Dear All,
I wish you a very happy Diwali and May almighty shower on each one of us, happiness, prosperity and end the woes we face in achieving permanent residency. I truly wish this for each of us. I think when we pray to almighty, we should collectively pray for this cause. Who knows, maybe lord will help us out soon.
This forum has been great to all of us in finding solace, and importantly exchanging knowledge and ideas.
Happy Diwali once again. I know they may delete this thread but I think they shouldn't because many others will offer their good wishes too. Amidst our worries, we should be able to cheer up in the light of Diwali and keep our spirits up and march ahead for another wonderful year.

Good question. I'm not sure if the two-year home residency requirement applies to tourist visas.
But if your J-1 program isn't subject to the two year residency requirement, I don't see why there would be a problem.

I made address changes to pending EAD renewal and I-485 yesterday in the afternoon for myself and spouse. Same day later in the evening I got email saying CPO for EAD renewal. This is a story of 8/20/2008.
I tried called 800 number and was told that they can't verify that address was successfully changed on the application.THey don't have access to personal information. They are asking me to take Inforpass to verify the address.
There is no LUD on either I-485 or EAD renewal after address change. Is LUD an indication that address change has been done? There are no infopass available for 2 months ( I will keep checking if somebody cancels )
Does anybody has any pointer as to how I can verify address change without infopass

I applied an LC from an employer on March 27th 2005 (Pre-PERM)
It is shifted to P-BEC. I have not got any 45 day letter for that

Is the email printout of 140 approval enough to attach to 485 app.
I have not received the printed notice and do not want to wait for it.
I want to go ahead with attaching approved email of 140.

Got LUD on I-485 one month after EAD/AP approval. What could this mean?
I got a soft LUD with no change in case status on I-485. PD is July 2006.

My I-140 petition was denied 2 months back and My attorney is trying to re apply for it. In the mean while there is a query on the company it self and our attorney is working hard to get it cleared.
In the mean while I am thinking about switch the employer.
I am in 8 th year extension and My VIsa is valid until jan 2008.
1.Assuming some comany offered me to apply for I140 and 485 and join that the company, what will happen If I140 has not been cleared before Jan 2008?.
2.What are the pros and cons I should think about when I switch the company.?

the new law provides that she would be automatically reclassfied to an appropriate category, presumably family-based 2B, and that she retain her father's original priority date. This would be the date that his employer submitted the labor certification application.

One of my friends was in the same boat as yours and he said YES. No problem in visa issuance. And as per my friend, the officer already knew that he was attending school. I think the schools report all enrollment to USCIS.
Also my wife went for visa interview recently. She is on H4 and she also said yes to Q33.

I had contributed $1000 towards my FSA dependent care account in 2010.
Now, in order to claim this amount, both husband and wife should be working, this is not the case with me, as my wife was not able to find a job in 2010.
Will this amount be reimbursed to me by the FSA management company ? as my son went to a preschool, and i paid the school fees every month.

I think answer is NO if you want to come back of L1A from B employer.
To be eligible for L1A, You need to be on outside USA payroll from B employer for atleast 1 year (from past 3 years).
With H1B, you will be on USA's payroll for that period.
